In Context provides occupational therapy and allied health services, including NDIS supports, private therapy, workplace return to work coordination and early intervention. We take your privacy seriously and handle personal information in line with the Privacy Act 1988 (Cth), the Australian Privacy Principles and, in NSW, the Health Records and Information Privacy Act 2002 (NSW).

This policy explains what we collect, why, how we use and protect it, and how you can access it or make a complaint.

What we collect

Depending on how you deal with us, we may collect:

  • Contact details: name, phone, email, address and date of birth.
  • Health information: medical history, diagnoses, assessment results, treatment notes, reports and information from your treating team.
  • Funding and claim details: NDIS number and plan details, plan manager or support coordinator details, workers compensation claim numbers, insurer details and Medicare or private health fund details.
  • Employment information (for workplace services): your employer, role, duties, work capacity and return to work plans.
  • Business contact details: for people who work with us, refer to us or enquire about our services.
  • Website and marketing information: information you give us through forms (including LinkedIn lead forms), your email preferences, and general website usage data collected through cookies and analytics tools.

You can deal with us anonymously or under a pseudonym where that's practical, but we usually need to identify you to provide health services or bill a funding body.

How we collect it

We collect information directly from you wherever possible: in sessions, by phone, email, online forms and our website. With your consent, or where the law allows, we may also collect it from others, such as your GP and treating practitioners, support coordinators, plan managers, the NDIA, insurers, employers, or a family member or guardian.

Why we use it

We use personal information to:

  • provide, coordinate and improve our services;
  • communicate with you and your treating team;
  • write reports, plans and assessments;
  • coordinate a safe return to work with your employer and insurer;
  • process payments and claims with funding bodies;
  • meet our legal, professional and AHPRA obligations;
  • respond to enquiries and send information you've asked for; and
  • with your consent, send occasional updates about our services.

Who we share it with

We only share personal information for the purpose it was collected, with your consent, or where the law requires or allows it. This may include:

  • your GP, specialists and other treating practitioners;
  • the NDIA, plan managers and support coordinators;
  • workers compensation insurers, scheme agents and your employer, limited to what's needed for your recovery and return to work;
  • clinicians and contractors who deliver services on our behalf, who are bound by confidentiality;
  • service providers who help us run the business, such as IT, cloud storage, email, booking and accounting providers; and
  • regulators, courts or authorities where required by law.

We never sell personal information.

Overseas disclosure

Some of the technology providers we use may store data on servers outside Australia. Where this happens, we take reasonable steps to make sure those providers handle information consistently with the Australian Privacy Principles.

Marketing

We only send marketing emails to people who have asked to hear from us or whose business contact details are published for a relevant role. Every email identifies us and includes an easy way to unsubscribe. You can opt out at any time by using the unsubscribe link or emailing us.

Cookies and analytics

Our website uses cookies and similar tools, including analytics and the LinkedIn Insight Tag, to understand how people use the site and to show relevant ads. These collect general usage information, not health information. You can block or delete cookies in your browser settings.

How we protect and keep it

We store information securely in password protected, access controlled systems, and limit access to the people who need it. Our clinicians and contractors are bound by confidentiality.

We keep health records for as long as the law requires. In NSW this is generally at least seven years after your last service, or for a child, until they turn 25. When information is no longer needed, we securely destroy it or remove anything that identifies you.

Accessing and correcting your information

You can ask to see the personal information we hold about you, or ask us to correct it. Contact us using the details below. We'll respond within 30 days. In rare cases the law allows us to refuse access, and if so we'll explain why in writing.

Data breaches

If a data breach is likely to cause serious harm, we'll notify affected people and the Office of the Australian Information Commissioner, as required under the Notifiable Data Breaches scheme.

Complaints

If you have a concern about how we've handled your information, please contact our Privacy Officer first. We'll acknowledge your complaint within 7 days and aim to resolve it within 30 days.
